president hugo chavez missed his own inauguration due to his help. he remains in cuba for more surgery for cancer. it is not yet known when he will be fit enough to head back home. venezuela's supreme court ruled the inauguration can take place at a later date, much to the annoyance of the opposition. let's speak to an author and historian who knows hugo chavez well and has and the view him on many occasions. has a president ever before in venezuela missed his own inauguration? >> it is totally new territory. >> he is seriously ill. some commentators suggest he is gravely ill and might never return to venezuela. is it legally allowed, according to the constitution? is it acceptable in terms of telehealth? >> yes, the constitution itself says and absolutely nothing about the time in which the president is inaugurated at the elections -- they took place last october. the inauguration was supposed to be today. i would imagine for a month or so after that, everybody would be perfectly happy. he is still president. just not in conditions to be president. >> the election he one by 11 points

that the situation surrounding their president hugo chavez is becoming quite serious. a lung infection is not so under control and it is now severe and used the term respiratory insufficiency. he is being treated in cuba where he went december 10 for cancer surgery. he is to be sworn in for a second term in office in just six days so that part is looky somewhat iffy. jill dougherty is live with us at the state department. those are reports that sound pretty dire. has it taken a while to get this information even out to the people of venezuela? >> there are people in venezuela who say they are not being told the full truth. if you read what the government people are saying and also just general information it looks pretty bad. i mean, mr. chavez has been treated for cancer for at least two years and now the prognosis does not look good. and that is what is bringing his possible imminent demise but also the confusion because he is not in venezuela. he is in cuba as you noted. that makes it really complicated to get sworn in again. and so that is a problem. and then you add on to this kind of odd q

hugo chavez could postpone his swearing in if it's not able to take the oath next week. that's according to the vice president. he made the comments in a televised interview yesterday. opposition leaders argue that new elections must take place if chavez is unable to be sworn in on january 10th. they say the constitution allows for him to be sworn in by the supreme court at a later date. chavez is recovering from his fourth cancer surgery. >>> caught on camera. a man leads police on chase and then tries to get rid of the evidence. dashboard cameras were rolling during this chase through a georgia town with speeds reaching as high as 85 miles an hour. suddenly, the man pulls over along a bridge and chucks a bag full of cocaine into the flint river. then he surrenders. but it was all for naught. the bag was vacuum sealed, floated in the river, and that made it easy more police to find it. >> very smart there. >>> police are warning parents about a new way some kids are getting away with drug use. take a look at this. police say it looks like candy, but it's actually marijuana.
